1. Acceptance of Terms

By accessing or using the FitOmg website, services, consultation programs, or any related offerings (collectively, the "Services") operated by Gyan Prabha & Team ("FitOmg," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms & Conditions in their entirety. If you do not agree with any provision herein, you must immediately discontinue use of our Services.

2. Nature of Services

FitOmg provides clinical nutrition consultation, personalized diet plans, wellness coaching, and related health guidance services. Our services are educational and informational in nature and do NOT constitute medical advice, diagnosis, or treatment. You should always consult with a qualified healthcare professional before making any changes to your diet, medication, or health regimen.

• We do not guarantee any specific health outcomes, weight loss results, or medical improvements.
• Results vary based on individual health conditions, compliance with plans, and other factors beyond our control.
• Our nutritionists are certified professionals but are not licensed medical doctors.

3. One-on-One Nutrition Consultation

The one-on-one nutrition consultation is a 30-minute secure video call focused on your specific nutrition concerns, including weight, PCOS/PCOD, thyroid health, and metabolic wellness.

• The consultation fee of ₹499 is generally non-refundable once booked. Rescheduling requests made at least 24 hours in advance will be accommodated without additional charge.
• Booking a consultation does not guarantee enrollment in any ongoing program.
• We reserve the right to decline service if we determine our programs are not suitable for your needs.
• You must attend the scheduled call on time. Missed calls without 24-hour prior notice may result in session fee forfeiture.

4. Payments & Refund Policy

Payments for FitOmg services cover custom clinical analysis, consultation time, and personalized plan development.Payments are generally non-refundable once a booking is completed or program delivery has begun.

In exceptional circumstances (such as technical failures or billing errors), refund requests or service credits may be granted at the sole discretion of FitOmg management. Please review our complete Refund Policy for details.

5. User Obligations

As a user of our Services, you agree to:

• Provide accurate, complete, and truthful health information during consultations.
• Disclose all existing medical conditions, allergies, medications, and relevant health history.
• Follow the prescribed nutrition plans responsibly and report any adverse reactions immediately.
• Not share, distribute, reproduce, or resell any diet plans, materials, or content provided to you.
• Not record, screenshot, or share consultation sessions without explicit written consent.
• Maintain respectful and professional communication with our team at all times.

6. Intellectual Property

All content, materials, diet plans, methodologies, branding, logos, website design, and proprietary information associated with FitOmg are the exclusive intellectual property of Gyan Prabha & Team and FitOmg. Unauthorized reproduction, distribution, modification, or commercial use of any materials is strictly prohibited and may result in legal action.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FitOmg, its owner, employees, consultants, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our Services.
• Any health outcomes or lack thereof resulting from following our nutrition plans.
• Any decisions you make based on information provided during consultations.
• Technical issues, service interruptions, or data loss.

Our total aggregate liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless FitOmg and its owner from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of a third party.

9. Termination

We reserve the right to terminate or suspend your access to our Services at any time, without prior notice, for any reason including but not limited to violation of these Terms. Upon termination, any refund or credit for unused portions of paid services will be evaluated at the sole discretion of management.

10. Modifications to Terms

FitOmg reserves the right to modify these Terms at any time without prior notice. Continued use of our Services after any modification constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
